Today [DEC-31-09] the Agency asked the public to comment on the draft interim remediation plans for cleaning up dioxins in soil. Details are below. Be sure to read more about the draft recommended guidance and how to comment at: http://www.epa.gov/superfund/policy/remedy/sfremedy/remedies/dioxinsoil.html Best wishes for a Happy New Year, Bonnie Piper Office of Public Outreach Office of Public Engagement Office of the Administrator O: 202-564-7836 Fax: 202-501-1770 email: piper.bonnie@epa.gov FOR IMMEDIATE RELEASE Dec. 31, 2009 EPA Seeks Public Input on Interim Guidance for Dioxins in Soil Cleanup Goals WASHINGTON - The U.S. Environmental Protection Agency (EPA) announced today it is seeking public comment on draft interim preliminary remediation goals (PRGs) for cleanup of dioxins in soil. Todayâs announcement fulfills a commitment by EPA Administrator Lisa P. Jackson to announce interim cleanup goals by the end of 2009.  Dioxins are contaminants that are very widespread in the environment that have been of concern to EPA and the public health community for decades.  This action would strengthen EPAâs preliminary remediation goals at dioxin contaminated sites. âWhile EPA works to complete the dioxin reassessment, this interim guidance will help us make better informed decisions on cleanup alternatives at contaminated sites,â said Mathy Stanislaus, assistant administrator for EPAâs Office of Solid Waste and Emergency Response. âWe are following through on our commitment to use the best available science to help protect human health and the environment.â Dioxins may cause a large number of different health effects, like cancer and reproductive effects. Dioxins are of concern because they are the result of combustion, and are absorbed from the air into the food chain where they can stay for many years. Currently, EPAâs recommended dioxin PRGs are 1,000 part per trillion (ppt) for dioxin in residential soil and a level within the range of 5,000-20,000 ppt in commercial/industrial soil. The draft interim PRGs proposed today are 72 ppt for residential land uses and 950 ppt for commercial/industrial land uses, thus lowering the amount of dioxins levels for residential land uses and commercial/industrial land uses. In addition, the draft interim PRGs differ from the current dioxin PRGs in that they include consideration of the potential absorption of dioxin through skin exposure. This will provide a tool for site evaluation that was not available when EPA last recommended PRGs for dioxins in soil in 1998. In 1991, in light of significant new data on the potential human health effects of dioxins, EPA began the development of a comprehensive evaluation of exposure and human health effects of 2,3,7,8-tetrachlorodibenzo-p-dioxin (TCDD), the most toxic of the group of chemicals known as dioxins, and other dioxin-like compounds. This draft dioxins assessment has been through several independent external peer reviews, the latest a 2004 review by a scientific panel convened by the National Academy of Sciences. When the EPA dioxin risk assessment is complete, it will be the agencyâs scientific foundation for future decision-making about dioxins in the environment. EPA will be taking public comment on the draft interim PRGs for 50 days following publication in the Federal Register, and anticipates issuing the final interim PRGs in June 2010. Upon completion of the dioxins reassessment, currently expected by the end of 2010, EPA will consider the need to update the interim PRGs. "...President Obama declared on Tuesday that “no information may remain classified indefinitely” as part of a sweeping overhaul of the executive branch’s system for protecting classified national security information.
In an executive order and an accompanying presidential memorandum to agency heads, Mr. Obama signaled that the government should try harder to make information public if possible, including by requiring agencies to regularly review what kinds of information they classify and to eliminate any obsolete secrecy requirements.
“Agency heads shall complete on a periodic basis a comprehensive review of the agency’s classification guidance, particularly classification guides, to ensure the guidance reflects current circumstances and to identify classified information that no longer requires protection and can be declassified,” Mr. Obama wrote in the order..."

"According to The Wall Street Journal, Asarco now is flush with cash and reporting a total profit, after its bankruptcy filing, of $623.4 million. So in the end, the company is also succeeding.
"Whether this result was due to good stewardship, excellent management, higher copper prices, appropriate judicial oversight by the bankruptcy judge, extraordinary good luck, or a combination of all these factors may be debated," U.S. District Judge Andrew S. Hanen wrote in his ruling of the case, "but the ultimate result is inarguable.""

TRUSTEE NAMED FOR ASARCO EL PASO REMEDIATION
Project Navigator will manage clean-up
“I am pleased to announce the appointment of Project Navigator, represented by Roberto Puga, as the custodial trustee for remediation activities at the ASARCO–El Paso site,” said Mark Vickery, executive director of the Texas Commission on Environmental Quality. “This highly respected and experienced firm will work with the TCEQ to advance toward closure of the site.”
On Nov. 13, the United States District Court for the Southern District of Texas in Corpus Christi issued an order confirming the plan of reorganization and implementing the settlement.
On either Dec. 11 or 14, the effective date of the plan, ASARCO will place $52,080,000 in an environmental custodial trust to address remedial activities. Funds totaling $52 million will be used at the El Paso site and the remainder will fund clean up at another non-operating site in Amarillo.
For the latest information on the clean-up plans and progress, see: http://www.tceq.state.tx.us/remediation/sites/asarco.html.

AND IN THIS ENTIRE PROCESS THE FEDERAL DEPT. OF JUSTICE, THE EPA, THE TCEQ, THE N.M. ENVIRONMENTAL DEPT. ---- NONE OF THEM HAVE DISCLOSED WHAT SECRET AND ILLEGAL HAZARDOUS WASTES REMAIN HERE FROM WHAT THE EPA SAID WAS ILLEGAL INCINERATION OF UNKNOWN TOXIC-WASTES FOR PROFIT (DURING THE ENTIRE 1990's).
A fraud of amazing proportions is occurring right before our eyes - and we would never have known what happened here if an honest Federal DOJ Attorney had not sent us (2006) the EPA-Asarco "confidential for settlement purposes only" 73 page document to the DOJ (1998) that finally gave us the truth.
But the DOJ, the Bankruptcy Trustee, the EPA, the NMED, and the TCEQ all are ignoring that document as if it was never made public and as if the contents were still secret.
WHAT happened here in El Paso during the secret incineration of military wastes that is SO BAD that none of these Government Agencies can be open and honest with us??! It had to be very bad.
WHY is there a Swiss Bank named "ASARCO AG" created about the time that the smelter shut down?
HOW CAN OUR ENTIRE JUSTICE SYSTEM (THE BANKRUPTCY TRUSTEE AND THE COURTS), THE FEDERAL EPA, THE STATES OF NEW MEXICO AND TEXAS ENVIRONMENTAL QUALITY DEPARTMENTS -- ALL FAIL TO DISCLOSE THE CONTAMINATION REMAINING FROM THESE YEARS OF ILLEGAL INCINERATION OF MILITARY AND INDUSTRIAL WASTES??!!??
WE DO NOT EVEN HAVE DIOXIN DATA FOR THE EL PASO ASARCO SMELTER. NO DIOXIN DATA. NO URANIUM DATA.
IS THE U.S.A. JUSTICE AND ENVIRONMENTAL SYSTEMS SO CORRUPTED THAT WE CAN'T EVEN GET DIOXIN DATA BEFORE A PALTRY 52 MILLION DOLLARS IS "handed down" TO US TO CLEAN UP THE RIO GRANDE, AN INTERNATIONAL AQUIFER (the HUECO BOLSON), OUR CITIES AND OUR AIR??!!??
HOW COULD OUR GOVERNMENT HAVE SAT ON THIS FOR THREE YEARS AFTER THE TRUTH CAME OUT? HOW MANY CHILDREN MUST BE BORN HERE WITH TERATOGENIC BIRTH DEFECTS BEFORE ANYTHING IS DONE TO DETERMINE WHAT HAS HAPPENED HERE??!!??
Travis County District Attorney Rosemary Lehmberg on Friday announced the appointment of the agency's first full-time environmental crimes prosecutor.... Patty Robertson.... will be based in Travis County but will prosecute cases throughout the state.
The Travis County District Attorney's Office has statewide venue on most environmental crimes under Texas law, officials said."
