Who gamed the Bankruptcy system?

WHY DID THE ENTIRE BANKRUPTCY "SYSTEM" IGNORE THE LIABILITIES FROM what the EPA/DOJ told us (after 8 years of secrecy!) was THE ILLEGAL and SECRET BURNING OF UNMANIFESTED WASTES FOR PROFIT, incinerated over YEARS?!  Who exactly gamed the Bankruptcy system?  The owners of ASARCO or the regulators?  We have evidence that the regulators knew what happened and concealed it in 2001 from the community.  What deals have been made to sacrifice the peoples of the Paso del Norte region to this contamination, and why?!?

Why has the Asarco Bankruptcy completely ignored what was almost a decade of illegal toxic poisons spread over El Paso/Juarez/N.M. and E. Helena MT by these burnings of military and industrial unreported wastes??

Rep. Reyes, Chair of the House Intelligence Committee said that Asarco paid MILLIONS on condition that the details of what it had done were never made public.    WHY WERE THESE POISONS NEVER MADE PUBLIC?  Why couldn't the Chair of the House Intelligence Committee make these poisons public?   Why have we never been told what these poisons are -- even after an international La Paz committee made a recommendation/resolution that the background contamination be studied and reported?!?

EPA ASARCO Texas "Factsheet" fails to mention the years of Sham Recycling (the illicit burning of secret hazardous-wastes for profit) -- that the Federal Dept. of Justice Bankruptcy Trustee failed to make the Asarco Bankruptcy court declare liabilities.  NO LIABILITIES FROM THE YEARS OF ILLEGAL SECRET TOXIC-WASTE BURNING WERE EVER CONSIDERED/DISCLOSED DURING THE ENTIRE ASARCO BANKRUPTCY COURT PROCEEDING --- OUR GOVERNMENT ACTED AS IF IT NEVER HAPPENED EVEN AFTER AN HONEST DOJ ATTORNEY MADE THE PUBLIC DISCLOSURE IN 2006 THAT THIS **DID** HAPPEN AND THAT FOR YEARS ASARCO MADE $$ WITH THE SECRET BURNING OF UNMANIFESTED HAZARDOUS-WASTES FROM BOTH MILITARY AND INDUSTRIAL SOURCES.   GOD ONLY KNOWS WHAT WAS INCINERATED HERE AND IN E. Not only that, but the Texas Agreement means that the EPA and TCEQ will never sue Asarco for hazardous wastes as a Civil Action in either El Paso or the Dona Ana County (Sunland Park) area:

TCEQ Commissioners Welcome New EPA Region 6 Administrator
EPA and TCEQ to discuss new public participation rules

Texas Commission on Environmental Quality commissioners today hosted recently appointed EPA Region 6 Administrator Dr. Alfredo “Al” Armendariz at the commission headquarters in Austin. The purpose of the visit was not only to welcome the new administrator to his new position but also to discuss the various rules regarding Texas’ successful air program. Yesterday, commissioners approved for publication a new rule package seeking to expand public participation in the state’s air permit process.

"Texas' air quality permitting program is already one of the most robust in the nation,” said Chairman Bryan W. Shaw, Ph.D.  “The TCEQ has taken proactive, aggressive measures to improve air quality in Texas. Air emissions and pollution concentrations in our state are at their lowest level in the past 20 years, while Texas continues to maintain a strong, growing economy.”

"I have always viewed public participation as a vital component in the permitting process," said Commissioner Buddy Garcia.  "I appreciate Dr. Armendariz spending time with each of us today, and I look forward to working with him to show the rest of the nation how Texas has been successful and will continue to lead on environmental issues.”

Texas already has a meaningful and engaging public participation process that directly impacts permits and provides significant environmental safeguards,” said Commissioner Carlos Rubinstein. “I welcome the rule changes that will provide even greater public participation and transparency.”

A public hearing to accept comment on the proposed rule revisions will take place January 25, 2010, at 10:00 a.m. in Building E, Room 201 S, at the TCEQ campus, 12100 Park 35 Circle, in Austin.   The comment period will end on February 16.

Asarco cleaned up Spic and Span when it should be the Federal DOJ that is getting cleaned-up

-- Asarco cleaned up Spic and Span with help from the Federal Department of Justice who failed to acknowledge a confidential-for-settlement-purposes-only  document that their fellow DOJ attorney released to a public information request, and that let us know the EPA had told the DOJ in 1998 Asarco had burned unmanifested/secret hazardous-wastes for profit, for years.   The Federal DOJ Bankruptcy trustee FAILED to make the Bankruptcy courts act on this evidence and failed to hold ASARCO accountable for the liabilities from this secret and toxic hazardous-wastes (both industrial and military origins).

What is our nation of laws coming to when huge corporations like ASARCO (its  parent company is partially owned by the Carlyle Group) are allowed to use our courts to "clean up" their financial image by ignoring basic facts which should have been considered in the bankruptcy-setting?

Everyday working people - the same taxpayers that bailed out the banks - are now in-effect bailing out ASARCO and its creditors because a few Government's employees allowed this company escape its culpability (as we speak, the Supreme Court has re-opened the ENRON case to reconsider the "honest services provision" of the mail and wire fraud act that holds such government employees accountable (why?)).

Our UTEP students are still walking around exposed to these levels of Arsenic; and the new plan is to build a UTEP research park at Asarco's site

Red dots: Residential Properties that Exceed 46 ppm (As) and/or 500 ppm (Pb) (883)
Green dots: Residential Properties that are Equal to or Below 46 ppm (As) and/or 500 ppm (Pb) (1640)

from 2/2004 Sample Location Map El Paso County Metals Survey, El Paso, El Paso County, Texas [USEPA REGION 6 START-2]

At a recent TXDOT open-house Mr. Berry indicated that the I-10 & Schuster Interchange Project had found no problems (i.e. no toxic levels of anything). The area he was referring to is shown on this map as where RIM Road extends down to the end of Sunbowl Drive toward Paisano. He stated that UTEP was building that new [Nursing/Health Sciences] building right there, and said that surely there could be no problem if UTEP was building right there...

But, this EPA map shows that the area on Sunbowl Drive where that building has been placed is next to a sea of red dots -- indicating that the dirt was likely very toxic before UTEP started breaking ground.

The TXDOT project and the UTEP building are happening in the midst of this sea of red dots; and, the government is doing nothing.

Asarco "cleaned up" and the Taxpayers "cleaned out"??

It is easy to run a profit when ignoring nearly ten years of contamination from illegal un-manifested hazardous-waste incineration without a license.

And why is there a Swiss Bank called "ASARCO AG" (Asarco SA, Asarco inc)?!

"According to The Wall Street Journal, Asarco now is flush with cash and reporting a total profit, after its bankruptcy filing, of $623.4 million. So in the end, the company is also succeeding.

"Whether this result was due to good stewardship, excellent management, higher copper prices, appropriate judicial oversight by the bankruptcy judge, extraordinary good luck, or a combination of all these factors may be debated," U.S. District Judge Andrew S. Hanen wrote in his ruling of the case, "but the ultimate result is inarguable.""

High on its to-do list is addressing concerns of the United Steelworkers, which represents about 1,700 Asarco workers. Grupo has until Jan. 15 to present a comprehensive proposal to the union outlining what it would offer in a new contract.

The union's current contract expires in June. Grupo has offered to extend the contract for a year, but the union wants a three-year extension to 2013 similar to its negotiated deal with Sterlite."

We agree with the observations about the TCEQ, but the pages (sent to constituents in an email) totally miss mentioning how the EPA proved Asarco secretly burned unknown (unmanifested!) hazardous-wastes for years, for profit, during the 1990's -- and that we only found out after the Federal DOJ made a 1998 confidential-Asarco-EPA-settlement document public in 2006 -- after EIGHT YEARS of silence and secrecy!!

We ask all of our political representatives/senators to let the community know what Asarco actually did here -- and, we want to know what chemicals have been left here from those years of illegal secret-wastes incineration.

TRUSTEE NAMED FOR ASARCO EL PASO REMEDIATION
Project Navigator will manage clean-up

“I am pleased to announce the appointment of Project Navigator, represented by Roberto Puga, as the custodial trustee for remediation activities at the ASARCO–El Paso site,” said Mark Vickery, executive director of the Texas Commission on Environmental Quality. “This highly respected and experienced firm will work with the TCEQ to advance toward closure of the site.”

On Nov. 13, the United States District Court for the Southern District of Texas in Corpus Christi issued an order confirming the plan of reorganization and implementing the settlement.

On either Dec. 11 or 14, the effective date of the plan, ASARCO will place $52,080,000 in an environmental custodial trust to address remedial activities. Funds totaling $52 million will be used at the El Paso site and the remainder will fund clean up at another non-operating site in Amarillo.

The ASARCO BANKRUPTCY COVER-UP IS COMPLETE??

"The Texas Commission on Environmental Quality has named a trustee who will be in charge of cleaning up the ASARCO site...Mark Vickery, TCEQ's executive director, appointed Project Navigator, represented by Roberto Puga, as the trustee. ..In mid-December, ASARCO will put $52,080,000 in an environmental custodial trust to support the clean-up."
http://www.kvia.com/Global/story.asp?S=11560816

AND IN THIS ENTIRE PROCESS THE FEDERAL DEPT. OF JUSTICE, THE EPA, THE TCEQ, THE N.M. ENVIRONMENTAL DEPT. ---- NONE OF THEM HAVE DISCLOSED WHAT SECRET AND ILLEGAL HAZARDOUS WASTES REMAIN HERE FROM WHAT THE EPA SAID WAS ILLEGAL INCINERATION OF UNKNOWN TOXIC-WASTES FOR PROFIT (DURING THE ENTIRE 1990's).

A fraud of amazing proportions is occurring right before our eyes - and we would never have known what happened here if an honest Federal DOJ Attorney had not sent us (2006) the EPA-Asarco "confidential for settlement purposes only" 73 page document to the DOJ (1998) that finally gave us the truth.

But the DOJ, the Bankruptcy Trustee, the EPA, the NMED, and the TCEQ all are ignoring that document as if it was never made public and as if the contents were still secret.

WHAT happened here in El Paso during the secret incineration of military wastes that is SO BAD that none of these Government Agencies can be open and honest with us??!   It had to be very bad.

WHY is there a Swiss Bank named "ASARCO AG" created about the time that the smelter shut down?

HOW CAN OUR ENTIRE JUSTICE SYSTEM (THE BANKRUPTCY TRUSTEE AND THE COURTS), THE FEDERAL EPA, THE STATES OF NEW MEXICO AND TEXAS ENVIRONMENTAL QUALITY DEPARTMENTS -- ALL FAIL TO DISCLOSE THE CONTAMINATION REMAINING FROM THESE YEARS OF ILLEGAL INCINERATION OF MILITARY AND INDUSTRIAL WASTES??!!??

WE DO NOT EVEN HAVE DIOXIN DATA FOR THE EL PASO ASARCO SMELTER.  NO DIOXIN DATA. NO URANIUM DATA.

IS THE U.S.A. JUSTICE AND ENVIRONMENTAL SYSTEMS SO CORRUPTED THAT WE CAN'T EVEN GET DIOXIN DATA BEFORE A PALTRY 52 MILLION DOLLARS IS "handed down" TO US TO CLEAN UP THE RIO GRANDE, AN INTERNATIONAL AQUIFER (the HUECO BOLSON), OUR CITIES AND OUR AIR??!!??

HOW COULD OUR GOVERNMENT HAVE SAT ON THIS FOR THREE YEARS AFTER THE TRUTH CAME OUT?  HOW MANY CHILDREN MUST BE BORN HERE WITH TERATOGENIC BIRTH DEFECTS BEFORE ANYTHING IS DONE TO DETERMINE WHAT HAS HAPPENED HERE??!!??

Businessman gets 5 years in Synagro case

"Businessman gets 5 years in Synagro case
BY BEN SCHMITT AND JOE SWICKARD

FREE PRESS

Detroit businessman Rayford Jackson, a key figure in the Synagro sludge-hauling scandal in Detroit, was sentenced this afternoon to the maximum prison sentence he could receive under his guilty plea -- five years.

Jackson, 44, had previously pleaded guilty to a conspiracy to commit bribery before U.S. District Judge Avern Cohn, who today rejected a request from Jackson’s lawyer that he be given only two years in prison.

Defense lawyer Richard Morgan said that Synagro “should be standing here, and they’re not.”
Assistant U.S. Attorney Michael Bullotta disputed defense claims that Jackson was somehow lured into the bribery scheme. “Nothing could be further from the truth,” he told the judge. He also challenged the claim that, for all its notoriety, the now-canceled Synagro contract with the city would have ultimately benefited Detroiters. “It was all about Rayford Jackson,” Bullotta said. "He stood to make millions.”

In dispensing the maximum sentence, Judge Cohn noted with displeasure the defendant’s refusal to acknowledge his wrongdoing, even after he admitted to his misdeeds. “Mr. Jackson has not displayed contrition and remorse and he has not apologized,” Cohn said.

But the judge added, Jackson, who has refused to cooperate with investigators in the ongoing probe, still has an opportunity to improve his fate. He instructed Jackson that if he decides to cooperate with the feds within the first year of his prison term, the length of his sentence could be revisited.

“There’s still an opportunity for you to express contrition and remorse in the form of cooperation,” he said.

Jackson, a flashy entrepreneur who traveled through Detroit political circles with an attractive young television anchorwoman on his arm, arrived in court this afternoon dapper – and silent – as ever. He wore a dark, double-breasted pinstriped suit and a black bowler with a jaunty feather, which he wore into the courtroom.

Bullotta said Jackson “and Jackson alone decided to bribe Monica Conyers,” the former Detroit city councilwoman who herself is awaiting sentencing in January for her role in the Synagro scandal.

Bullotta said the evidence showed Jackson was operating actively and independently because he did not tell disgraced Synagro official James Rosendall about bribing Conyers until after Jackson had done so. Jackson, the prosecutor said, operated out of “pure greed.”

Jackson is slated to report to prison on Jan. 15.

After the verdict, U.S. District Attorney Terrence Berg said, “I hope this will be a deterrent to anyone considering any type of similar conduct in the form of bribing public officials.”

After issuing the sentence, Cohn took time to commend the FBI and U.S. Attorney’s office and likened their efforts to Hercules, who in Greek mythology cleaned the stables of Augean stables full of thousands of cattle in a single day."

El Paso ASARCO illegally and secretly burned Toxic waste for years

"RCRA makes it a crime for a person to knowingly treat, store or dispose of hazardous waste without a permit. 42 U.S.C. § 6928(d)(2)."

So why isn't someone in Jail, after El Paso ASARCO (and E. Helena MT Asarco) illegally and secretly burned Toxic waste for years?

And, why is there a Swiss Bank named ASARCO A.G. (Asarco S.A., Asarco Inc.)??

Why won't the Federal DOJ Bankruptcy Trustee require that the Bankruptcy Court considers ALL liabilities for ASARCO -- i.e. the liabilities from years of secretly burning military and industrial toxic wastes for profit?

What in the heck is going on?

Sham Recycling leads to Sham Asarco bankruptcy and sham decisions

  • Why won't the Dept. of Justice Bankruptcy Trustee require that the Bankruptcy court consider the liabilities from the secret military and industrial wastes illegally burned at Asarco El Paso and E. Helena for many years?
  • Isn't it illegal to not require full disclosure of the toxic wastes in the Asarco bankruptcy?
  • Why won't the news disclose how Carlyle Group owns 20% of Grupo Mexico?
  • Why did the EPA report that the Beta Radiation levels in El Paso just before Asarco shut down were the highest in the USA?
  • The shut down occurred soon after the TCEQ made an abrupt decision to not bring nuclear wastes to this region for disposal, after all.
  • Why weren't we told the truth for eight years (from 1998 to 2006), and why are the government and attorneys acting as if that secret document is not now public??
  • Why won't the government disclose what poisons are still here from those activities?
  • Why does Grupo Mexico plan to bid on a Pacific coast seaport - to run it for 50 years and bring rail freight through a port of entry about only ten miles from the Asarco El Paso epicenter?  How could such construction and planning be done if the true extent of the toxic-waste contamination were exposed?
  • What happened here?!?

Scientists can find Water on the Moon but not ASARCO Toxic Waste in El Paso

It has been  three Years since the Federal Dept. of Justice made public an EPA/Asarco confidential settlement document detailing how Asarco (El Paso, TX and E. Helena MT) secretly burned military and industrial wastes for profit --- and, U.S.A. scientists cannot tell the community what poisons were left here.

Yet, scientists can track water down to the ATOM on the moon.

"There is water on the Moon, scientists stated unequivocally on Friday...."The water findings came through an analysis of the slight shifts in color after the impact, showing telltale signs of water molecules that had absorbed specific wavelengths of light. “We got good fits,” Dr. Colaprete said. “It was a unique fit.” The scientists also saw colors of ultraviolet light associated with molecules of hydroxyl, consisting of one hydrogen and one oxygen, presumably water molecules that had been broken apart by the impact and then glowed like neon signs."

Why aren't the TCEQ and EPA letting El Pasoans know about the MERCURY levels around the ASARCO plant?

Asarco Tacoma stack contaminated a hundred square miles...

and the Asarco East Helena stacks?  "The EPA said tests showed that an area of about 100 square miles had been affected to some degree by Asarco emissions."
http://www.helenair.com/news/article_782a2871-8aa9-56d9-9752-0664afd8c9d5.html

So doesn't this suggest that the Asarco El Paso smelter likely has affected 100 square miles, too?  That would be any land (and water) 30 miles out from the Asarco site -- almost clear up to Las Cruces, and definitely throughout Santa Teresa.

So why aren't our environmental regulatory agencies telling us about this in El Paso and Sunland Park?  (TCEQ, NMED and the Federal EPA)?

Dept. of Health and Human Services

The ATSDR is the "Dept. of Health and Human Services". Umm. Isn't
this the agency that we have evidence covered up the Asarco
contamination in Sunland Park N.M., and that was recently investigated
by a Federal investigative committee for fraud?

DEQ confirms that East Helena MT ASARCO stack demolition was "safe" (E. Helena burned unmanifested toxic wastes, too)

The way that authorities are getting around the safety issue is to NOT LOOK for the unmanifested toxic wastes that both Asarco El Paso and Asarco E. Helena handled and burned (nearly ten years of the incineration).

So, how much credibility does this safety assurance have with the public now?  None.   The conflicts of interest preventing full disclosure are so common that to this day we do not have Dioxin data, PCB data, mercury data, polonium data, or uranium data for the El Paso Asarco stack area --- and, to this day no citizen group has been given split samples/funds to take these samples to a non-conflicted scientist/lab.

Former construction mgr for Hueco Bolson toxic-waste removal plant (i.e. "Desal Plant") now slated to be IBWC commissioner

How long will the El Paso community tolerate the continued cover-up of Asarco's chemical contamination from its citizens?

The EPA said that Asarco had contaminated the international Hueco Bolson.  Fort Bliss and the EPWU then constructed the Desal Plant on military property, taking the chemical contaminants from the water and pumping these twenty miles away for deep-well-injection on military property.

The EPA and other agencies have not told us what toxic chemicals remain at ASARCO despite an honest Dept. of Justice Attorney releasing a formerly confidential-for-settlement-purposes-only EPA-DOJ Asarco report in 2006 letting the community know about Asarco's secret and illegal activities from the 1990's.

Our TCEQ Director was replaced by a former military person whose background was clean-up of chemical weapons contamination.  Our City of El Paso new Sustainability ("Green") Director used to be in charge of the clean-up of chemical contamination from Rocky Mt. Arsenal (which sent material to Asarco El Paso TX for illegal incineration according to the EPA).  The Federal State Dept. stated that the IBWC workers are sick and cannot get independent medical care in the entire region -- but nothing has been done.

Now, our IBWC commissioner's background includes building the EPWU/military DeSal plant that removes salt and most chemical contaminants (including Asarco's) from the Heuco Bolson water:

"Drusina was construction manager for over $28 million of infrastructure construction associated with El Paso Water Utilities’ desalination plant."
